Terms of Service for OFF SHORE NZ**

By accessing or using the website and purchasing products from OFF SHORE NZ, you agree to be bound by the following Terms of Service ("Terms"). If you do not agree with these terms, do not use the website or purchase any products.

1. Products 

OFF SHORE NZ offers the following products for sale:

- Digital Presets: Custom editing presets designed to enhance your photos.

- Prints: Physical prints of artwork, photographs, or designs.

The details of these products, including product descriptions, images, and pricing, are displayed on the website and are subject to change without notice.

2. Digital Presets

By purchasing digital presets from our website, you acknowledge and agree to the following:

- Color Variation: Results of applying the presets may vary depending on several factors including camera model, lighting conditions, image resolution, and editing software. We make efforts to provide high-quality, consistent presets, but the final output may not match the promotional images shown.

- No Guarantees on Results: Every image is unique, and applying our presets may not always achieve the desired outcome. You may need to make additional adjustments based on your specific photo, camera settings, or software. We do not guarantee that the presets will work in the same way on all images.

- No Refunds: Due to the digital nature of this product, all sales of presets are final. Once purchased and downloaded, no refunds, exchanges, or cancellations will be issued.

3. Prints

By purchasing physical prints, you acknowledge and agree to the following:

- Color and Texture Variations: The colors of prints may appear different from what you see on your screen due to monitor calibration, lighting conditions, and print material. We strive to produce high-quality prints, but slight variations in color, texture, and finish are normal and not considered defects.

- Custom Orders: If you place a custom print order, the final print may vary slightly from the image shown on the website due to material choice and production processes. Any specific requests should be clearly communicated at the time of purchase.

- Production and Shipping: All prints are custom-made upon order. Production and shipping times may vary based on availability, order volume, and shipping location. We are not responsible for delays caused by third-party shipping providers or customs procedures.

- No Refunds on Prints: Due to the custom nature of print products, all sales are final. No refunds, exchanges, or returns will be accepted once the order has been placed and shipped.

4. Payment and Billing

- Billing Information: You are responsible for providing accurate and complete billing information. In the event that billing information is inaccurate or incomplete, we may delay or cancel your order.

- Pricing: All prices are listed in NZD excluding taxes and shipping costs, which may be applied at checkout. We reserve the right to update pricing or make changes without prior notice.

5. Shipping and Delivery

- Shipping Rates: Shipping costs will be calculated at checkout based on the delivery address and the type of product purchased.

- Delivery Times: Estimated delivery times are provided at checkout, but we cannot guarantee these times. Delivery times may vary based on location, carrier delays, or customs processing (for international orders).

- Tracking: A tracking number will be provided once your order has shipped. We are not responsible for lost or delayed packages once they are in the possession of the shipping carrier.

6. Intellectual Property

- Ownership: All content, including but not limited to the digital presets, artwork, images, text, logos, and designs found on the website, are owned by OFF SHORE NZ or its licensors and are protected by copyright, trademark, and other intellectual property laws.

- Licensing: When you purchase digital presets, you are granted a limited, non-transferable license to use them for personal or commercial use. Redistribution, resale, or sharing of the presets is strictly prohibited without prior written consent.

7. User Responsibility

- Use of Products: You are responsible for how you use the digital presets and prints. You agree not to use the products for illegal purposes or in a manner that infringes on the intellectual property rights of others. Prints cannot be bought for Commercial use. PERSONAL USE ONLY.

- Accuracy of Information: You agree to provide accurate and complete information when placing an order. Any errors or issues caused by inaccurate information are your responsibility.

8. Limitation of Liability

To the fullest extent permitted by law, OFF SHORE NZ is not liable for any damages, losses, or expenses arising from the use of our products, including but not limited to any indirect, incidental, or consequential damages. This includes, but is not limited to, errors in editing, print quality, shipping delays, or any misuse of the products.

9. No Refunds

Due to the nature of our products:

- All digital presets are non-refundable once purchased and downloaded.

- All print orders are final and non-refundable once processed or shipped.

Please ensure that your order is accurate before finalizing the purchase.

10. Changes to Terms

We reserve the right to modify or update these Terms at any time. Any changes will be posted on this page with an updated "Effective Date." It is your responsibility to review these Terms periodically to stay informed about any updates.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved in the competent courts of New Zealand.
